End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you and AllAboutApps Inc. ("Company") governing your use of our mobile applications ("Licensed Application") and related web-based services, including the Labs section available on our website.

By downloading, installing, accessing, or using our Licensed Application or web-based services, you agree to be bound by this Agreement.

1. Acknowledgment

You and AllAboutApps Inc. acknowledge that this Agreement is concluded between you and AllAboutApps Inc. only, and not with Apple. AllAboutApps Inc., not Apple, is solely responsible for the Licensed Application and its content.

2. Scope of License

The license granted to you for the Licensed Application is a non-transferable, non-exclusive license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

For web-based services, including Labs, you are granted a limited, non-exclusive, non-transferable right to access and use such services for personal, lawful purposes only.

3. Maintenance and Support

AllAboutApps Inc. is solely responsible for providing any maintenance and support services with respect to the Licensed Application. You and AllAboutApps Inc. acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

Web-based services, including Labs, may be modified, suspended, or discontinued at any time without prior notice.

4. Warranty Disclaimer

All services are provided on an "as is" and "as available" basis.

AllAboutApps Inc. is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Licensed Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

To the fullest extent permitted by law, AllAboutApps Inc. disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Licensed Application or web-based services will operate uninterrupted, secure, or error-free.

5. Limitation of Liability

To the fullest extent permitted by applicable law, AllAboutApps Inc. shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the use of, or inability to use, the Licensed Application or web-based services.

In jurisdictions where limitations of liability are restricted, liability shall be limited to the maximum extent permitted by law.

6. Product Claims

AllAboutApps Inc., not Apple, is responsible for addressing any claims of the user or any third party relating to the Licensed Application or web-based services, including but not limited to:

• (i) product liability claims;
• (ii) claims that the Licensed Application or services fail to conform to applicable legal or regulatory requirements;
• (iii) claims arising under consumer protection, privacy, or similar legislation.

7. Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or web-based services infringe intellectual property rights, AllAboutApps Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claims.

All content, trademarks, and materials provided within the Licensed Application and website remain the property of AllAboutApps Inc. or its licensors.

8. Legal Compliance

You represent and warrant that:

• (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and
• (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Acceptable Use (Web Services)

You agree not to use the website or Labs services for unlawful purposes, attempt to interfere with or disrupt service operation, or reverse engineer, duplicate, or exploit the services beyond permitted personal use.

10. Third Party Beneficiary

AllAboutApps Inc. and the user acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement with respect to the Licensed Application, and that Apple has the right to enforce this Agreement as a third-party beneficiary.

11. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the Licensed Application or web-based services following updates constitutes acceptance of the revised Agreement.
